This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our websites fleet.toecan.tech, movit.toecan.tech, support.toecan.tech, toecan.tech, toecan.com, any subdomains of those websites, use our fleet tracking and driver coaching solution, and interact with our application. Please read this policy carefully to understand our views and practices regarding your personal data and how we will treat it.

We encourage you to read this document carefully so that you know why and for what purpose we process your personal data. You will also find your rights and how to exercise them. We also explain which personal data we process when you:

  • use our services
  • receive our offers or quotations

1. Information We Collect

We collect information directly from you and through your use of our services.

1.1 Personal Information

  • Account Information: When you create an account, we collect information such as your name, email address, phone number.
  • Driver Information: Where applicable, we collect driver identifiers such as driver ID, driver's, employer or fleet affiliation, and assigned vehicle(s).
  • Vehicle Information: Information about the vehicle(s) you operate, such as make, model, year, license plate, Vehicle Identification Number (VIN), and fleet identifier.

1.2 Device and Vehicle Telematics Data

  • Telematics Hardware Data: Data collected from our in-vehicle hardware and connected devices, including GPS location, speed, acceleration, braking, cornering, engine status, mileage, and trip start/end events.
  • Smartphone Sensor Data: Data collected directly by the Toecan Fleet application on your smartphone, including GPS location (while in use and, with your permission, in the background) and phone unlock events detected during an active trip. Phone unlock events are used as an indicator of potential distraction and contribute to your safety score.
  • Driver Behavior Data: Derived events and scores relating to driving style, such as harsh acceleration, harsh braking, tailgating, speeding, coasting, cruise control usage, and cornering.
  • Device Data: Information about your device, such as IP address, device type, operating system, and app version.

1.3 Usage Information

  • App Usage: Data on how you use our application, such as features accessed, time spent on the app, and navigation patterns.
  • Website Usage: Information about your interactions with our website, including pages visited, links clicked, and browsing history.

1.4 Location Data

Location data is collected while using the app, and with permission of the user also with the app in the background, within the smartphone and (where applicable) smartwatch applications, for the following purposes:

  • Emergency assistance: Detecting crashes, harsh impacts, or anomalous driving events so that automatic alerts can be sent to emergency contacts or services.
  • Trip tracking: Recording metrics such as distance, duration, speed, and route to help drivers and fleet managers monitor trips and vehicle usage.
  • Route mapping: Providing visual representations of driven routes for trip review, fleet management, and analysis.
  • Driver coaching and safety features: Offering personalized tips, coaching, and recommendations to promote safe driving habits and reduce risk.

1.5 Media usage

Media usage information is collected within the smartphone application for the following purpose(s):

  • Media playback: Whether (yes/no) media is being played while performing a trip, with the purpose of accounting for potential distraction during driving through the calculation of safety scores.

1.6 Video Telematics Data (where enabled)

Where a connected in-vehicle camera or video telematics device is used as part of your Toecan Fleet deployment, we may process:

  • Video footage of the road and/or the driver cabin, triggered by safety-relevant events (e.g. harsh braking, collisions, distraction indicators).
  • Derived event metadata such as event type, timestamp, and associated telematics data.

Video data is processed to enable driver coaching, incident review, and fleet risk management, and is retained only for as long as necessary for those purposes. Fleet operators are responsible for informing drivers of camera use in accordance with applicable law.

2. How We Use Your Information

We use your information to provide, maintain, and improve our services, as well as to develop new features.

  • Service Delivery: To track vehicles, analyze driving behavior, calculate safety scores, deliver coaching content, and provide real-time data and alerts.
  • Account Management: To manage your account and provide customer support.
  • Communication: To communicate with you about your account, respond to your inquiries, and send you updates about our services.
  • Improvement and Development: To analyze how you use our services and to develop new features and enhancements, including the continuous improvement of our driver behavior and risk models.
  • Compliance: To comply with legal obligations and protect our legal rights.

3. Legal Basis for Processing Your Information

We process your personal data based on the following legal grounds:

  • Consent: Where you have given consent for us to process your personal data for specific purposes.
  • Contract: Where processing is necessary for the performance of a contract with you or with the fleet operator that has provisioned your account, or to take steps at your request before entering into a contract.
  • Legal Obligation: Where processing is necessary for compliance with a legal obligation.
  • Legitimate Interests: Where processing is necessary for our legitimate interests or those of a fleet operator (e.g. fleet safety, loss prevention, operational efficiency), provided that your interests and fundamental rights do not override those interests.

4. Sharing Your Information

We do not share your personal data with third parties except in the following circumstances:

  • Fleet Operators: Where you use Toecan Fleet as part of a fleet operated by your employer or a third party, relevant trip, telematics, and driver behavior data is shared with that fleet operator in accordance with their agreement with Toecan.
  • Service Providers: We may share your information with third-party service providers that perform services on our behalf, such as hosting, data analysis, payment processing, and customer support.
  • Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities.
  • Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

5. Data Security

We use administrative, technical, and physical security measures to protect your personal data. While we have taken reasonable steps to secure the personal data you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable.
